Please review these terms before booking. If anything’s unclear, contact us, we’re happy to help.

1) Booking & Quotes

Quotes are valid for 14 days unless otherwise stated. A booking is confirmed once we acknowledge your request and receive a 25% deposit.

2) Pricing & Payment

Prices are shown before tax. A 25% deposit confirms your booking, with the balance due after your event finishes, unless written otherwise. We accept common electronic methods.

3) Cancellations & Rescheduling

Notify us as early as possible. Cancellations within 48 hours of your event may be subject to a fee. We’ll always try to reschedule subject to availability.

4) Equipment Use & Safety

  • Adults only may operate machines; keep children clear of hot or moving parts.
  • Use grounded outlets; keep equipment dry and on a stable surface.
  • Follow all operating instructions provided at delivery.

4a) Use at Own Risk

By accepting a quote, paying a deposit, or operating any rented equipment, you acknowledge that popcorn, cotton candy, and snow cone equipment involves inherent risks including burns from hot surfaces, sharp or moving parts, electrical shock, allergic reactions, and slip-and-fall hazards. Equipment is used entirely at your own risk. You agree to supervise minors, ensure a safe operating environment, and follow all instructions provided by Kernels and Cones. Kernels and Cones disclaims any liability for injury, illness, or damage arising from your or your guests' use of the equipment, except where prohibited by law.

4b) Self-Serve Rentals

Self-serve (no operator) rentals are intended for private events only (such as weddings, birthdays, or private corporate gatherings). For events open to the public, an operator package may be required to comply with applicable public health and food safety regulations. The renter is responsible for verifying and complying with all health, food safety, and licensing requirements applicable to their event and location.

5) Damage, Loss & Cleaning

Normal cleaning is included. Excess cleaning, damage, or loss caused by misuse may be charged at replacement/repair cost.

6) Allergens & Ingredients

Ingredients can vary by brand/flavour. For guidance, see our Nutritional & Safety page. We can omit butter topping and use coconut-free oil on request.

7) Service Area & Travel

We serve the Greater Toronto Area (Toronto, Halton, Peel, and York). Travel fees may apply outside core zones or for extended durations.

8) Weather & Access

Client provides a weather-appropriate, covered setup area and standard power. Unsafe conditions (water ingress, severe winds, etc.) may require us to pause or halt service.

9) Liability

We are not liable for indirect or consequential losses. Our total liability is limited to the amount paid for the booking, except where not permitted by law.

10) Force Majeure

We aren’t responsible for delays or non-performance due to events beyond our control (e.g., extreme weather, utility outages).

11) Privacy

We only collect information needed to process your booking and communicate about your event. See our privacy notes upon request.

12) Changes to These Terms

We may update these terms occasionally. The version in effect on your booking confirmation date applies to your order.

13) Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario, sitting in the County of Peel or the City of Toronto. The customer submits to the exclusive jurisdiction of those courts.
